PayU payments Terms of Service

§ 1. Rules for the provision of the Service

  • The Regulations define the terms and conditions of payment for invoices via the website https://magwise.pl for Egostim sp. z o.o. hereinafter referred to as the Seller with headquarters in Warsaw: Egostim sp. z o.o., ul. Smolna 34/26, 00-375 Warsaw, NIP: 5252867468
  • The entity providing the PayU service hereinafter referred to as the "PayU Service" for Users, is PayU S.A. with headquarters in Poznań, 60-324 Poznań, at ul. Marcelińska 90, entered into the register of entrepreneurs kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under number 0000274399, with a share capital of PLN 4,000,000 fully paid up, with NIP: 779-23- 08-495, hereinafter referred to as the "Payment Operator". When implementing the PayU Service, the payment operator acts as a payment service provider within the meaning of the Payment Services Act of 19th August 2011 (Journal of Laws 2011.199.1175 as amended). The body supervising the Payment Operator is the Polish Financial Supervision Authority.
  • In order to use the Service, it is necessary to have a device that allows access to the Internet, including a program for browsing its resources.
  • KAny person paying invoices (hereinafter referred to as the Customer, Buyer, User) at https://magwise.pl for Egostim sp. z o.o. is obliged to read the regulations. Ignorance of the Regulations does not release the Customer from the rules contained therein.
  • At the time of paying the invoice, the Customer confirms that he has read these regulations and confirms that he accepts them in the valid form.

§ 2. PAYU service for buyers

  • By providing the PayU Service to the Buyer, the Payment Operator transfers the received funds to the Seller's payment account no later than by the end of the next business day after the Payment Operator receives the payment order from the Buyer. The payment order is received by the Payment Operator on the day on which the Payment Operator's bank account has been credited with the amount resulting from the transfer made by the Buyer.
  • The payment operator provides the PayU Service on the basis of the payment order submitted by the Buyer, the submission of which takes place by completing the application form, in which the Buyer indicates the person of the Seller (it is possible to submit multiple payment orders at the same time by indicating multiple Sellers), the amount of the payment and the legal title to make the payment. If the required payment is not made within 10 days from the date of submitting the application, the order will be automatically canceled.

§ 3. PAYU Service for Sellers

  • Payment operator providing the PayU service to Egostim sp. z o.o. (hereinafter referred to as the Seller) runs the Seller's payment account and, at the Seller's request, transfers the funds accumulated on the payment account to the bank account indicated by the Seller or by postal order, subject to Art. 2. The PayU service for the Seller is carried out on the basis of a framework agreement, the provisions of which are included in these regulations.

§ 4. Methods of payment for goods

  • As part of the PayU Service, the Payment Operator supports:
    • a. payments made by electronic transfers, including non-cash payments in Polish currency made by online transfers
    • b. payments made by traditional transfers outside the Internet or other electronic transfers
    • c. payments made with payment cards, including non-cash payments in Polish currency made with payment cards that have been approved by banks for transactions in the Internet environment
    • d. payments made with the use of other methods made available by the Payment Operator, enabling the repayment of the Buyers' obligations towards the Sellers. 2. § 5. Privacy and Confidentiality

  • The administrator of personal data within the meaning of the Act of 29th August 1997 on the Protection of Personal Data (i.e., Journal of Laws of 2002, No. 101, item 926, as amended) is the Payment Operator. Users' personal data are processed in accordance with applicable law by the Payment Operator for the purpose of providing services, archiving, as well as for marketing purposes regarding the services and products of the Payment Operator and cooperating entities. By using the PayU Service, the User will not receive marketing and commercial information if he or she does not consent to it.
  • Users' data may be made available only to entities authorized to receive them under applicable law, including the competent judicial authorities.
  • The payment operator provides Users with the implementation of the rights resulting from the above-mentioned Act, i.e., allows Users to view and correct their own personal data. In the cases specified in the provisions of the law, the User has the right to submit a motivated written request to stop processing his personal data.
  • Privacy, protection against unauthorized access, and other possibilities of loss or destruction of confidential information are protected by the Payment Operator through technical and organizational security.
  • Personal data provided by users of the website www.magwise.pl are processed by Egostim sp. z o.o. with headquarters in Warsaw, at ul. Smolna 34/26. The entrusted personal data is used only for the purpose of payment for the Service and will only be used for this purpose.
  • Personal data is not shared with other entities for marketing purposes. The Customer has the right to view, supplement, update, rectify, refrain from processing, and delete personal data if they are incomplete, out of date, untrue or were collected in violation of the law, or are no longer necessary to achieve the purpose for which they were collected. Other rights and obligations of the Customer in the field of personal data are specified in the Act of 29th August, 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended).

§ 6. Complaints procedure

  • The User may submit a complaint if the services provided for in these Regulations have not been performed or are performed contrary to its provisions.
  • Complaints may be submitted in writing to the address of the Payment Operator or electronically, using the contact form on the PayU website: http://www.payu.pl. The complaint should contain at least the name and surname of the person submitting the comments and a description of the objections raised.
  • The payment operator recognizes the complaint within 14 days from the date of its receipt.
  • The User agrees that the response to the complaint will be sent to the e-mail address assigned to the User's Account. In particularly justified cases, the Payment Operator may send a reply to another e-mail address indicated by the person submitting the complaint, which is not assigned to the Account.
  • The User is obliged to cooperate with the Payment Operator in order to clarify all issues related to complaints carried out by payment card issuers and financial institutions, as well as supervisory authorities, in particular, he is obliged to provide all necessary information regarding the transaction for which the claimed payment was made and on every request. The Payment Operator, within 7 days of receiving such a request, provide the Payment Operator with copies of documents regarding the implementation of the transaction, under which the User made a payment made with a payment card or by transfer using the Service, including: a copy of the confirmation of the purchase of goods or services. The User is obliged to keep these documents for a period of at least 24 months from the date of payment.
